Arizona Supreme Court Bans All Abortions

On Tuesday, the Arizona Supreme Court used an obscure 1864 law to ban almost all abortions in its state. The pre-statehood law mandates 2 to 5 years in prison for anyone aiding an abortion, except if the procedure is necessary to save the life of the mother.
“Physicians are now on notice that all abortions, except those necessary to save a woman’s life, are illegal … and that additional criminal and regulatory sanctions may apply to abortions performed after fifteen weeks’ gestation,” the ruling stated.
With a woman’s right to choose among the most important issues voters will use to make their choice at the ballot box this November, the ruling could end up handing Democrats major victories across all branches of government.
According to The New York Times, Democrats immediately seized on the Arizona Supreme Court ruling.
President Biden led the pack by blaming Donald Trump for the loss of abortion rights — and noted that he has taken credit for appointing the US Supreme Court justices who overturned the constitutional right to abortion.
“This ruling is a result of the extreme agenda of Republican elected officials who are committed to ripping away women’s freedom,” Mr. Biden said in a statement minutes after the decision.
Vice President Kamala Harris, who will travel on Friday to Tucson, AZ for a previously planned discussion on abortion rights, also chimed in.
“Arizona just rolled back the clock to a time before women could vote — and, by his own admission, there’s one person responsible: Donald Trump,” she said.
“There really is no way to sugarcoat it. Today is a dark day for Arizona,” said Angela Florez, president and CEO of Planned Parenthood Arizona.
Rep. Ruben Gallego, who is the Democratic candidate in Arizona running for the US Senate, called the ruling “devastating for Arizona women and their families” and warned that “women could die” as a result of the new ban.
However, Kari Lake — the Trump/MAGA sycophant who is the Republican candidate in Arizona running for the US Senate — shockingly agreed with Democratic ire against the ruling, despite having praised the law in the past.
“It is abundantly clear that the pre-statehood law is out of step with Arizonans,” Lake said in a statement. “This is a very personal issue that should be determined by each individual state and her people.”
For his part, Donald Trump went uncharacteristically silent on the ruling as well as the words from Mr. Biden, Ms. Harris, and the others. However, his spokesperson delivered a lukewarm response to the attack.
“President Trump could not have been more clear. These are decisions for people of each state to make,” spokeswoman Karoline Leavitt said in an extremely brief response.
The Arizona Supreme Court ruling will not be enforced immediately. Instead, the court has put its ruling on hold and will send the matter back to a lower court to hear additional arguments about the legislation’s constitutionality.
Following the Supreme Court’s decision to overturn Roe v. Wade in 2022, a woman’s right to choose has emerged as one of the Democrats’ strongest political weapons in 2024. If Democrats ride the issue all the way to the November election, it could motivate voters to head to the polls, prompt independents to turn their backs on the GOP, and potentially send President Biden, Vice President Harris, and even House Speaker Hakeem Jeffries to Washington in 2025.
