The US Supreme Court appears poised to give the Jan. 6, 2021, Capitol Hill rioters and Donald Trump himself a “Get Out Of Jail Free” card.

For anyone who doesn’t yet realize that elections have consequences and that the allegedly impartial and “non-political” US Supreme Court is loaded with a bunch of conservative sympathizers, comes news that the nation’s highest court is preparing to let hundreds of insurrectionists simply walk away free without consequence. More specifically, the conservative justices want to make it harder (or even impossible) for the US Justice Department to prosecute any of the Capitol Hill rioters who participated in the 2021 deadly attack against democracy — although it’s unclear how they will justify their actions while still attempting to “appear” fair.

According to CNN, the Supreme Court indicated Tuesday that it is likely to invalidate hundreds of cases against the insurrectionists solely because several justices dislike the methods the Justice Dept. used to seek out and go after the violent mob.

Justice Dept. officials have been prosecuting insurrectionists using a case known as Fischer v. United States, which involved a federal law that states anyone who obstructs, influences, or impedes any official proceeding, or attempts to do so commits a very serious federal felony and can be imprisoned for up to 20 years.

Conservative critics claim that it’s wrong to dish out felony charges against members of the Jan. 6th MAGA mob — and argue that the law was originally intended to prevent evidence tampering and not a protest in support of a president who was challenging an election.

However, members of the Supreme Court seem set on rebranding the events of Jan. 6, 2021, as a political “protest” and not a violent insurrection. By doing so, they could provide cover to those who ransacked the Capitol, killed 1 police officer and assaulted many others, made threats against the lives of members of Congress, and nearly succeeded in preventing the democratic tradition of a peaceful transfer of power.

“There have been many violent protests that have interfered with proceedings,” conservative Justice Clarence Thomas (whose wife, Ginni Thomas, attended Trump’s incendiary rally on January 6th and plotted with Trump allies on ways to keep him in power after he lost the election) stated during arguments. “Has the government applied this provision to other protests in the past?”

“What happened on January 6th was very, very serious,” but we need to figure out the “outer reaches” of the statute, Justice Samuel Alito said in a thinly veiled attempt to find some legal maneuver to excuse the violent MAGA mob — and Donald Trump.

To date, more than 1,265 people have been arrested for attacking Capitol Hill and Congress. So far, approximately 330 of them have been charged under the obstruction statute related to the Fischer case.  

If the Supreme Court rules as expected, charges against the Capitol Hill rioters could be diminished or erased altogether. More importantly, the court’s ruling could also halt the federal election subversion criminal case pending against Donald Trump, who was also charged with obstruction.

I would posit that there’s NOT 1 institution in America that hasn’t been corrupted over the past 20-25 years, Especially the U.S. Supreme Court during Trump’s presidency!

Whatever the larger consequences of the court’s ruling, expected by late June, several justices on Tuesday seemed troubled by the government’s interpretation of the law, saying it would allow many other kinds of prosecutions.

“Would a sit-in that disrupts a trial or access to a federal courthouse qualify?” Justice Neil M. Gorsuch asked. “Would a heckler in today’s audience qualify, or at the State of the Union address? Would pulling a fire alarm before a vote qualify for 20 years in federal prison?”

I asked my boss about this. The justice department is not prosecuting everybody under the same law. Only the most serious cases. But it still looks like the Supreme Court is looking for a way to mainly help Trump out and also excuse a lot of the people that attacked the Capitol.

When DJ said elections have consequences he is exactly right. The court is nothing but conservatives trying to hold onto conservative thinking. They are not impartial like they pretend. We can thank voters electing Trump and Repubs who cheated to load the court up.
