Ferguson Grand Juror Files Lawsuit

“Grand Juror Doe” filed a lawsuit in federal court on Monday against McCulloch, claiming that evidence was presented to the grand jury in a manner extremely different than in previous cases heard by the same grand jury, with the insinuation that Brown was the “wrongdoer” rather than Wilson. The lawsuit also claims the prosecutor’s office presented applicable laws to grand jurors “in a muddled and untimely manner” unlike presentations in other cases.
The grand juror insists McCulloch’s public statements about the decision not to indict were not “entirely accurate,” including the “implication that all grand jurors believed that there was no support for any charges,” the lawsuit stated.
“Grand Juror Doe” opposes the imposed gag order and is arguing that state laws prohibiting him or her from talking about the case are unconstitutional. Jeffrey Mittman, executive director of the American Civil Liberties Union in Missouri agrees with the grand juror, saying the Brown case is an important public policy issue and the grand juror should be allowed to speak about the proceedings.
McCulloch’s office is remaining silent on the issue, since any success with the lawsuit or permission for the grand juror to speak publicly could present at best an embarrassment for the prosecutor’s office and at worse, a renewal of the indictment against Darren Wilson.
I always knew there was something fishy about that prosecutor. I hope the lawsuit goes through and the jury is allowed to tell us what really happened. Then maybe some real justice can happen.
