Immunity Doesn’t Apply To Trump, Says Court

Only a day before the US Supreme Court will hear oral arguments regarding Trump’s eligibility for the Colorado primary presidential ballot, a 3-judge panel of the US Court of Appeals for the DC Circuit has delivered ‘The Donald’ a bit of bad news. The ruling states that despite his opinion to the contrary, Trump can not and will not receive broad impunity from federal prosecution.
According to NPR, Trump and his attorneys argued that he should be privy to special privileges — including immunity from federal prosecution. However, lawyers for special counsel Jack Smith argued that such a move would “undermine democracy” and give presidents license to commit crimes while in The White House, including accepting bribes for directing government contracts or selling nuclear secrets to a foreign adversary.
The panel of judges found the Trump argument nonsensical.
DC Circuit Judge Florence Pan pressed a Trump attorney to explain how his argument could make sense but also prevent a president from selling pardons or nuclear secrets, or even ordering a Navy SEAL team to kill a political opponent. She added that his theory would allow that president to evade criminal prosecution.
Judge Karen L. Henderson agreed and noted that it seemed “paradoxical” that presidents would pledge to faithfully execute the laws, only to violate those same laws because they’ve been given legal protection.
Donald Trump has been charged with 4 felony counts, including a conspiracy to cling to power and disenfranchise millions of voters in 2020. Despite Trump’s “not guilty” plea, prosecutors say his actions on Jan. 6, 2021, culminated in the violent insurrection at the US Capitol that injured 140 law enforcement officers and shook the fabric of American democracy.
In light of his failed bid for immunity, Trump is widely expected to appeal the decision to the full DC Circuit or (his appointees on) the US Supreme Court. Trump has also made it clear that if he is re-elected in November, he will dismiss all federal cases being levied against him.
